Aims
  • The student is able to display knowledge about the science of History of Law, to destile important facts, events, topics, developments from an analysis of the course materials and to recognise the tendencies in cultural and political history as the context for the continental legal - and Common Law tradition.
  • The student is able to describe the main characteristics of the evolution of criminal law and tort law.
  • The student is able to relate legal concepts and casus to already gained knowledge of the (continental) legal tradition.
  • The student understands the difference between external - and internal legal history.
  • The student knows about the diverse fields of research in legal history.
  • The student is able to sum up and to dwell on controversies in legal history and to relate them to already gained knowledge of European legal history in general.,
  • The student is able to answer complex questions regarding the history of law, including the history of criminal law and tort law, thereby proving to master the subject of the course by describing, evaluating, reflecting and concluding on the matter.and

Content
During this course we will, first,study the external legal history of Western Europe (9 lectures + 3 discussion classes) The course aims to familiarize students with and provide insight in the historical development of our contemporary law, seen in its politcal and cultural context. Using the Roman and Canonical law as a starting-point, we will deal with the evolution of legal sources, the developments in the legal science, the rise of the nation state, and the codification process.The continental tradition will be the main subject, the Common Law tradition will be discussed shortly. Students will also be presented at one of the fields of research in legal history, the history of criminal law (3 lectures + 3 discussion classes). In all lectures and workgroup classes we will call upon the students' responsibility for the preparation and understanding of the literature prescribed. Detailed information regarding the teaching programme, with respect to content as well as procedure, will be announced on Blackboard Courseinfo in due course.
